Terms and Conditions

These Terms and Conditions (“Agreement”) apply to all services provided by Frozen Muskox (the “Company”) to the customer (“Client”). By submitting payment, the Client agrees to the following terms.


1. Pricing and Taxes

  • All prices are listed in Canadian Dollars (CAD).
  • Canadian customers are subject to applicable federal and provincial taxes.
  • U.S. customers are exempt from Canadian tax, and payment will be converted at the applicable exchange rate at the time of payment.


2. Payment Terms

  • One-time Packages: Payment may be made by credit card, debit card, or e-transfer.
  • Subscription Packages: A valid credit card must be kept on file. Subscriptions are subject to a 12-month minimum contract. After 12 months, subscriptions may be renewed or cancelled.


3. Ownership of Services and Content

  • All hosting accounts and domain registrations will be created in the Client’s name and/or business name.
  • The Client retains full ownership of website content created by the Company.
  • If a subscription is cancelled after the initial 12-month term, the Client is responsible for arranging and paying for their own hosting and domain renewals.


4. Domain and Hosting Transfers

  • The Company will make reasonable efforts to transfer existing domains to new hosting accounts.
  • If additional labour is required due to access or transfer issues, a flat fee of $50 will apply.
  • Domain and hosting transfers may take up to 48 hours to become active.


5. Search Engine Optimization (SEO)

  • The Company will implement SEO best practices according to industry standards.
  • SEO rankings and results are not guaranteed, as performance depends on factors outside the Company’s control.


6. Google Business Setup

  • The Company will create and optimize a Google Business Profile as part of the service.
  • Visibility and performance results cannot be guaranteed.


7. Marketing Campaigns

  • The Company may provide marketing services, including but not limited to: email outreach, ad campaigns, and social media promotions.
  • Campaign strategies will follow recognized best practices and be tailored to the Client’s business and industry.
  • The Company cannot guarantee specific outcomes such as sales volume, lead conversions, customer engagement, or revenue increases.
  • The Client acknowledges that marketing performance is influenced by factors outside the Company’s control (including competition, market demand, platform algorithms, and customer behaviour).


8. Website Updates and Changes

  • Professional packages include up to five (5) basic changes within the first 12 months (text updates or photo swaps).
  • Larger design or structural changes will be quoted separately.
  • Certain updates may not appear immediately due to browser caching. Clearing cache may be required to view changes.


9. Website Monitoring and Support

  • For Professional Packages, the Company will monitor the website for 12 months to ensure it functions as intended.
  • Issues related to hosting or installation will be addressed during this period.
  • Basic email management (setup, removal of accounts, device setup guidance) is included for 12 months.


10. Client Responsibilities

  • The Client must provide all required logins, passwords, and access credentials for existing hosting and domains prior to project start.
  • The Client is responsible for the accuracy and legality of all content, images, and information provided.
  • Logos must be supplied by the Client. Optimization of supplied logos/photos is included; logo creation is quoted separately.


11. Liability and Limitations

  • The Company is not responsible for downtime, loss of data, or service interruptions caused by third-party providers (hosting, registrars, etc.).
  • The Company shall not be held liable for indirect damages, loss of business, or loss of revenue arising from the use of the website or marketing services.
  • Maximum liability shall not exceed the total amount paid by the Client for services rendered.


12. Termination

  • The Company reserves the right to suspend or terminate services if payments are not received or if the Client breaches this Agreement.
  • Upon termination, all remaining hosting/domain costs become the Client’s responsibility.


13. General Provisions

  • This Agreement constitutes the entire understanding between the parties and supersedes all prior discussions.
  • Updates to these Terms and Conditions may be made at any time. Clients will be notified of changes before renewal or new services begin.
